Nope, this is actually a pretty smart move. You just have to look at it as a strategic, not a tactical, one. Its not about thoughtcrime, it's about locking down multiple, competing members of his coalition.

The Black Community is somewhat displeased about Obama's declaration of support for gay marriage. Not enough to vote against him, but enough to diminish their overall support and enthusiasm. It's going to be a close election, and the Black Community is one group that Obama NEEDS to turn out at the same level as 2008 given the votes he's going to lose elsewhere.

What better way to "buy" their support back then have the Obama Justice Department charge Zimmerman with a hate crime?
