It makes more sense on the gubernatorial level. The reason is that in most states, the Attorney General is elected. In some states like mine, judges are elected, although appointed at times for partial terms.

Ginberg, Scalia, Breyer, and Kennedy are old. There's a good chance two, if not all of them will be appointed by the next POTUS. Eric Holder will be back if Obama wins, as will his cabinet.

There's also Harry Reid still controlling the Senate.
