First, a presidential election is decided by five people, who don't even try to explain their choice in normal legal terms. Anyone who claims that Bush v. Gore in 2000 was a 5-4 decision is either lying or ignorant. The real decision that Florida had to follow its own election laws (and especially no recount cherry picking in Democratic counties) was 7-2. The follow on 5-4 decision said that Florida had wasted so much time doing the recount illegally they didn't have the time to redo a legal recount completely before the due date so had to stick with their original results.
