The Justice Department moved Friday to shield Attorney General Eric Holder from prosecution after the House voted to hold him in contempt of Congress.
The contempt vote technically opens the door for the House to call on the U.S. attorney for the District of Columbia to bring the case against Holder before a grand jury. But because U.S. Attorney Ronald Machen works for Holder and because President Obama has already asserted executive privilege over the documents in question, it was expected Holder's Justice Department would not take that step.
Deputy Attorney General James Cole confirmed in a letter to House Speaker John Boehner that the department in fact would not pursue prosecution. The attorney general's withholding of documents pertaining to Operation Fast and Furious, he wrote, "does not constitute a crime."

Likely that it was all planned from the top. One intriguing, and devious, conspiracy theory has it that the goal of F&F was not another Assault Weapon ban, primarily, but instead was the destabilization and encouragement of civil war in Mexico which would in turn allow for all illegal Mexicans in the US to be declared refugees and thereby getting around the political taint of another actual amnesty. (That it could have generated another AWB in that case would have been a secondary benefit.)
Obama is refusing to enforce laws. What is happening to our country?
Simply put, if the laws were enforced as written a lot of public official would be in prison. This very much includes judges.
What you are seeing, especially with the Obamacare ruling, is that things are now decided to be legit by the very Powers That Be after the fact. That is, now what was illegal can be declared legal, and legal declared illegal at whim.
IOW, "The law is what we say it is!"

The ultimate decision on whether to prosecute will be made by the individual President Romney appoints as Attorney General.
And don't drop the investigation when these crooks are voted out of office in November.
Does Congress take an oath of office? They passed a law that was unconstitutional.
A portable "cell" is available from a number of sources ~ just rent one.
And if Holder won't come over invite Cole for a visit!

Nothing unusual about this refusal to prosecute, it’s SOP.
That’s why contempt votes lead to civil trials.
The Senate is not likely to work with them on the matter. On the other hand there’s nothing stopping the House from detaining Senators who stray into the House side of the Capitol building. After they get enough of them hogtied and sitting around awaiting their turn at the one portapotty in the portable cell, the remaining Senators will be much more willing to boldly go where no Senate has gone before.

The Republicans should just cut their funding off and have the Rep Senators stop all judicial appointments until they either cooperate or turn over the documents. Play hardball!If they don’t whats to stop any AG from even testifying before congress.

Why just yesterday the Congressional Black Caucus called this a racial witch hunt and half of the white Democrats walked out with them. Pretty much says that Nancy , Steny and others are in on the charade.Democrats are owned by the racial black vote, and Republicans are frightened by it.
