Well, that’s completely different. The emanations of the penumbras of the Constitution mean the founders unambiguously intended to turn all decisions about the killing of babies over to the federal courts. It’s right in the Constitution. So in that case, what the American people think is not important.
By way of contrast, the fathers intended Congress’ powers to be limited and specifically enumerated. “Limited” is such a vague word that the supreme court must defer to the legislature on all matters regarding this issue.
