I’m not sure 5.3(e) is directed at Rush (or anyone else). The reference in 5.3(e) to “in those parts of the electromagnetic spectrum assigned to the Federal Government” seems to rule out commercial radio stations. The federal government has big swaths of spectrum already assigned to it—this seems to allow them to reassign it. There may be other parts of the EO to worry about, but the section 5.3(e) doesn’t seem to be one of them.
