I was commenting on the comment that this would never go federal because it was solely a state issue. My point was never think this administration would be above doing anything. Would you have imagined any President using executive orders to wipe away current laws, especially popular ones?

The state law v. federal law question only came up as an issue in this thread because someone else (with limited understanding of the U.S. Constitution, perhaps) had suggested that Obama would pardon Holmes. Your follow-on suggestion that the Governor of Colorado would "turn over" Holmes to the feds, upon request, only made sense to me in that context. As it is, I can't imagine there's even a hint of a possibility that anything other than state murder and other charges would be brought against Holmes.

But, hey, maybe Obama could, you know, issue one of them Executive Orders with which he can apparently do anything, and unilaterally invalidate the Colorado criminal code, so that Holmes has to be charged with federal crimes, or not at all.

As I said, sheesh.
