Blowing the whistle on the federal Leviathan

The huge humpback whale whose friendliness precipitated a surreal seven-year — so far — federal hunt for criminality surely did not feel put upon. Nevertheless, our unhinged government, with an obsession like that of Melville’s Ahab, has crippled Nancy Black’s scientific career, cost her more than $100,000 in legal fees — so far — and might sentence her to 20 years in prison. This Kafkaesque burlesque of law enforcement began when someone whistled.

Black, 50, a marine biologist who also captains a whale-watching ship, was with some watchers in Monterey Bay in 2005 when a member of her crew whistled at the humpback that had approached her boat, hoping to entice the whale to linger. Back on land, another of her employees called the National Oceanic and Atmospheric Administration (NOAA) to ask if the whistling constituted “harassment” of a marine mammal, which is an “environmental crime.” NOAA requested a video of the episode, which Black sent after editing it slightly to highlight the whistling. NOAA found no harassment — but got her indicted for editing the tape, calling this a “material false statement” to federal investigators, which is a felony under the 1863 False Claims Act, intended to punish suppliers defrauding the government during the Civil War.

No, it was a different crew member (not the whistler). NOAA requested tape and she sent the tape at their request.

Although, you might make the case that she had an obligation to know who worked for her and purge any statists. Why allow them to do work for which she'd be obligated to pay them, when they'd purchase food with it which would sustain their life, and they might even reproduce and make more statists? Just say no.

Just admit it. You didn’t read the article, did you.

You know the part where it says one of HER crew called NOAA to see if whistling was ‘harrassment’.

What can you say about stupidity on this grand scale?

What I can say is: its my belief that no Republican (and certainly no Democrat) can (or wants to) fix this out-of-control Federal Gov't. We had better hope that the Federal Leviathon goes bankrupt soon, while we still have some shreds of Federalism left, a few Americans who still believe in the Constitution, and some State and Local Gov'ts who can pick up the pieces.

Start using theses abusive acts to assault democrats and you will begin to see the media turn against the Federal Government’s abuses.

After Obama has been driven out of office I’d like to see a team of Federal prosecutors follow him like a hawk to legally harass him for every little thing until he is as broke as he made our country.

Maybe then Obama will start to see Government power is a bad thing. I would do likewise to prominent liberal members of the Media. Theses people might start publicly singing a different tune about Big government. Or at least be driven to recognize that having a big government places their freedom on the knife edge of an election.

At the very least we can get a loser pay system for Federal persecution.
