STATE ATTORNEY HOPES TO SETTLE THE CASE AGAINST OMAR WITHOUT A TRIAL

Several weeks ago, we reported to you that 22-year-old Omar Antonio Garcia Barrera’s planned sleep-over at Police Chief Donie Lee’s home last May 28 did not turn out as may have been planned.

Although Chief Lee says that he did not serve Omar any alcohol, Omar was reportedly falling-down drunk and had become “disorderly,” Lee said. After several warnings, Chief Lee said that, about 2:30 am, he personally escorted Omar out the door and to his car and told him to be gone. A DUI just waiting to happen.

But Lee says he offered Omar several options besides driving his car. In any event, the question being begged here is why did the Chief of Police allow a drunk friend to get behind the wheel of an automobile?

After escorting Omar to his car, Donie went back in the house and locked the door. And Omar did what Donie allegedly told him to do. He got into his car and started the engine. But instead of going forward, he shifted into reverse and accelerated.

And he continued to accelerate until he crashed into the chainlink fence at the rear of the Quality Inn.

In the process of bashing the fence, Omar also backed over a raised concrete curb and the rear tire on the driver’s side of the car was not touching the ground, according to Officer Jesse Young’s report.

Omar, now near-hysterical, ran back to Donie’s front door and rang the doorbell and, when Donie answered, Omar tried to push by him to get into the house. That didn’t work, and the fight moved to the front yard. A security guard at the Quality Inn said that the two men were “tumbling on the ground.”

Omar was subsequently arrested, charged with DUI, and hauled off to jail. He blew a .09 blood alcohol level on a police breathalyzer.

He also was charged with property damage.

Since that time, there have been several new developments in this story.

• First of all, the ICOP videos from two patrol cars have been made available for viewing. Those who have seen those videos say that Omar tearfully told one of the officers that the real reason Donie kicked him out of the house is that he resisted Donie’s sexual advances. Questions about this allegation and other questions were sent to Chief Lee early this week.

• Police spokeswoman Alyson Crean responded to our email to Donie this past Wednesday, but she only addressed whether or not Chief Lee got Omar drunk. She said that Lee did not serve Omar any liquor that night. She refused any further comment, saying that if the case goes to trial, the Chief would be called as a witness.

• The State Attorney’s Office (SAO) has opened a case file and prosecutors are in discussions with Omar’s attorney, Don Yates, about resolving the case. Yates has the reputation as one of the best lawyers in town with a per-hour fee to go along with his reputation. It would be interesting to know who is picking up that tab.

A source inside the SAO says that there is no plea deal in the works at this time. Maybe it’s too early for the SAO to speculate on how this case may go, it’s not too early for us to speculate.

• Omar will plead quilty to the DUI charges, avoiding the need for a trial.

• Managers at the Quality Inn will provide the dollar figure to repair the fence and Omar and his lawyer will agree to a restitution deal. And so that charge just goes away.

they're setting the kid up

someone bought the most expensive attorney in town who will tell the kid to take a plea rather than fight the chief of police

and nothing will happen to the chief and the state attorney will help broom this under the rug

Kid was probably drugged and then an attempted rape and then directed by the chief of police to get in his car and drive away and a patrol car just happens on the scene .. and the cop in the patrol car and the sargent on dispatch on a 2 x 4 island don't know the chief of police or his home address

the chief says he didn't give him any alcohol but his officers claim the kid was 'falling down drunk' at 2:30am after he turned down the chief's sexual homosexual advances

sounds like the kid was roofied in anticipation of a date rape

.09 equates to about 3 beers in an hour. Falling down drunk? I smell drugs in this equation.
