My point about penetration was with regard to the law in general, civil and UCMJ.
I just heard on Fox that the affair took place after he assumed D/CIA. The affair evidently DID NOT take place during the time he was the Commander in Afghanistan or while the bio was being researched and written.
Therefore, Petraeus was NOT subject to UCMJ while the alleged adultery took place.
I think we can all agree on that.

My sense of the criminal aspect of Broadwell/Petraeus was the divulgence of any classified info to an unauthorized person.
The other thing that strikes me as criminal has to do with when the affair became known and if anyone attempted to manipulate/extort Petraeus or any situation Petraeus might become involved in as a result of that knowledge.
It would be nice to someday learn that an attempt was made and that Petraeus simply decided to confess rather than be extorted.
I think that depends on who you choose to believe. For me the jury is still out. Petraeus was in the Army, Broadwell is an officer in the Reserves. I think both of them might have reason to claim the affair did not take place until he retired.
