Senate Bill 64: Revise nursing home regulation detail
Passed 67 to 37 in the House on September 22, 2015, to revise the extensive regulatory regime imposed on nursing homes, so as to establish that patient care policies, compliance procedures, outcome measures and more should be based on nationally recognized, evidence-based guidelines or best-practices (rather than regulations promulgated by state departments), along with other detail changes.

Senate Bill 65: Revise nursing home medical treatment restriction
Passed 69 to 35 in the House on September 22, 2015, to allow any nursing home to employ or contract with a licensed health care professional to provide a program of planned and continuing nursing care and medical treatment for residents. Under current law medical and dental treatment provided in nursing homes are subject to complex regulatory restrictions and constraints.

Senate Bill 491: Slightly expand alternative teacher authority
Introduced by Sen. Phil Pavlov (R) on September 16, 2015, to expand a law that allows schools to employ a teacher who has not obtained a government teaching certificate to teach courses in computer science, a foreign language, mathematics, biology, chemistry, engineering, physics and robotics. The bill would expand that list to include writing, journalism and health sciences. Current law requires a non-certified teacher to have a major or graduate degree in the relevant subject area, and the bill would also add recent professional experience in the field to this requirement.

Senate Bill 492: Clarify franchised business employee status
Introduced by Sen. Jack Brandenburg (R) on September 16, 2015, to establish that the owner of a business franchise rather than the franchisor is considered the sole employer of the workers for whom he or she provides a benefit plan or pays wages, except as otherwise specified in the franchise agreement, or where prohibited by law. The bill was introduced after President Obama’s appointees on the National Labor Relations Board issued a ruling that all franchise employees are actually employed by the franchiser for purposes of union organizing. Among other things, if sustained this policy would mean that employees at local restaurants franchised by a national chain like McDonalds could be unionized on a nationwide basis.

Senate Bill 494: Revise locked classroom doors law
Introduced by Sen. Judy Emmons (R) on September 16, 2015, to revise the state fire code to permit the use of lock block devices on school classroom doors, and locks that can lock a classroom from the inside without a key. “Lock block device” is defined as a device that prevents a classroom door from latching when closed, so that the door may kept locked at all times but still be used without the use of a key.

Senate Bill 495: Revise telemedicine insurance restriction
Introduced by Sen. Rebekah Warren (D) on September 16, 2015, to revise insurance code details to facilitate “telemedicine” services. Specifically, the bill would require insurers to include reimbursement for “asynchronous store and forward action,” which means sending data to a health care provider for later review. Under current law insurers are prohibited from reimbursing telemedicine services from a health care provider who is not licensed or “authorized” to practice in Michigan, and this restriction would not be changed.
