State: Don't delay George Zimmerman murder trial
The Orlando Sentinel ^ | February 1, 2013 | Arelis R. Hernández and Rene Stutzman

Posted on 02/01/2013 10:15:35 AM PST by Uncle Chip

Prosecutor Bernie de la Rionda today objected to a delay in George Zimmerman's trial, accusing defense attorney Mark O'Mara of spending too much time on media interviews and suggesting that O'Mara may be stalling because he's out of money.

O'Mara on Tuesday filed paperwork, asking Circuit Judge Debra S. Nelson to delay Zimmerman's second-degree murder trial, which is currently set for June 10.

O'Mara appears to want the trial pushed back to November, de la Rionda wrote, but deserves no additional time.

The state has done nothing in violation of Florida's rules of criminal procedures, de la Rionda wrote, and he's done far more to help O'Mara round up witnesses and evidence than he normally does.

O'Mara is the reason for the delay, de la Rionda wrote. The defense attorney has been slow to schedule depositions and sometimes cancels them at the last minute, de la Rionda said.

O'Mara has made it clear that he wants to investigate witnesses before he deposes them, something that slows the process.

For example, before he deposes her, he plans to review the Twitter and Facebook posts of a young Miami woman who says she was on the phone with Trayvon Martin, the unarmed black 17-year-old killed by Zimmerman when they came face to face.

That could mean a delay of several months while O'Mara pushes those two social networking sites for access to her account information.

The judge will hear both sides present argument for and against a trial delay on Tuesday.

De la Rionda today filed his written response to O'Mara's request for a trial delay: He objects.

The state does not wish Zimmerman find more holes in its charge.

Don’t just “not delay” it. Toss this piece of crap out altogether. Cancel the tm scholarship and remove his name from the martyr list. WTH? It’s not like he’s the second coming of MLK. Just another punk too big for his sagging britches.

I wonder if his peers understand that de la Rionda is the face of the state's prosecutorial function, and right now, he is not making the state look good.

He's opposed and smart-mouthed every request the defense has made. Not to mention, leading the witness during the investigation phase, when he is supposed to be open minded.

I hope he loses all his friends.

Zimmerman is the victim of a legal lynching. At one time there was, and probably still are, a sizable posse of lynch Zimmerman posse on this forum. The hell with the evidence. The hell with the law. Zimmerman killed, whether justified or not, a member of Holder’s protected class. And for that he must pay.

I notice that Bernie didn’t address any of these issues in his response to O’Mara’s motion:

B Witness 8 Recorded Interview with Benjamin Crump

“Only after receipt of this [poor quality] digital copy did it become apparent that the original has atleast seven starts, stops and edits in that the phone call lasted approximately 26 minutes, but there are only 14 minutes of recording.” [B12, p7]

C Trayvon Martin’s Phone:

“Analysis includes GPS locating records for Mr Martin’s phone for allthe time that he was in the Sanford area, specifically absent is any such data for February 26, 2012, the date of the event.”[C9, pp8,9]

“Similarly there seems to be missing entries regarding phone calls made to the phone or texts made to or from the phone in the evening hours of February 26, 2012” [C10, p9]

http://dailycaller.com/2012/03/25/santorum-zimmerman-has-a-very-sick-mind-motive-a-malicious-one/

On “Face the Nation” Sunday on CBS, Republican presidential hopeful Rick Santorum explained that his view of the Trayvon Martin shooting...

...Santorum placed the blame on accused shooter George Zimmerman’s mental state...

...“Obviously, in my opinion, someone … has a very sick mind who would pursue someone like this. This is clearly a heinous act. You know, there are a lot of people who have a lot of distorted views of reality. It’s a tragic, tragic case.”

“And my heart goes out to the parents, too. I can’t imagine what they’re suffering, losing their son in such a horrific way. All I would say is that, whatever the motive is, it was a malicious one, and a very, very tragic one.”

Since Zimmerman and his attorney began taking on the lefty press over the biased coverage, I noticed a marked change in the overall reporting. First of all, this is not a big issue any longer such as leading every news show, now it is back watered if at all mentioned. Second, gone are the references to Obama’s son, if he had one, as being a young innocent teen. They did a good job mitigating the damage the press was doing.

Were I the state’s attorneys, I’d be puckering up a bit now because it is becoming crystal clear this was a lynch mob out to get Zimmerman, truth and justice be damned.

I heard there are newly achieved access to phone records and data from the deceased cell phone and the state prosecution is refusing to release it to Zimmerman’s attorneys.

I notice the date is 03/25/12. Santorum probably didn’t get a chance to see Zimmerman’s bloody broken nose and bloody scalp.

Yep — regarding the phone found at the scene:

“Analysis includes GPS locating records for Mr Martin’s phone for all the time that he was in the Sanford area, specifically absent is any such data for February 26, 2012, the date of the event.”[C9, pp8,9]

“Similarly there seems to be missing entries regarding phone calls made to the phone or texts made to or from the phone in the evening hours of February 26, 2012” [C10, p9]

If Bernie doesn’t have an exit strategy, he should get one.

If he does have one, he’d best be dusting it off right about now.

The state has done nothing in violation of Florida's rules of criminal procedures, de la Rionda wrote, and he's done far more to help O'Mara round up witnesses and evidence than he normally does.

The defense has not receive full tapes of Trabant's final phone call. Trovon's phone tracked his location and they have not received all that info.

And from the date I’d say Santorum hadn’t had a chance to find out George Zimmerman wasn’t Jewish.

If the prosecution is indeed dragging its feet or worse destroying evidence then the continuance should be charged to them and lett speedy trial dates start running.

DEFENDANT’S MEMORANDUM OF LAW IN SUPPORT OF ITS POSITION REGARDING THE PROSECUTOR’S OBLIGATION TO DISCLOSE INFORMATION

http://184.172.211.159/~gzdocs/documents/discovery_matters/prosecutors_obligation.pdf

Filed again today in response to the state’s response — in case Bernie and/or Judge Nelson forgot to read it back on October 25th, 2012
