It’s not necessarily the military that will be piloting the drones - DHS could have that ability as well. No Posse Comitatus violation occurs if that’s the case.

US Constitution, Article II, Section 2, "The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States..." and Article I, Section 8, "The Congress shall have Power...; To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;"

Of course, you changed the focus and the above does not mean, as you wrote, “He can kill anyone of us without due process using the US Military to do so.”
