Sure, I understand your argument, and it might carry some weight, except...

• In 1860, secession by itself did not cause war, and
• The Confederacy had already formally declared war on the United States when Virginia's voters ratified secession.

So, of all eleven Confederate states, only Virginia and Tennessee voters finally approved secession after the Confederacy's declaration of war.

Therefore, Virginia and Tennessee voters exercised both their "right to secede" and their "right to declare war on the United States" with the same amazing votes!

Well, at least they knew what they were getting, right?

Virginia had the right to secede, and exercised that right.

It was a lawful action on the part of Virginia.
