Sure, I understand your argument, and it might carry some weight, except...

So, of all eleven Confederate states, only Virginia and Tennessee voters finally approved secession after the Confederacy's declaration of war.

Therefore, Virginia and Tennessee voters exercised both their "right to secede" and their "right to declare war on the United States" with the same amazing votes!

Well, at least they knew what they were getting, right?

That point is moot in relation to this argument.

Virginia had the right to secede, and exercised that right.

It was a lawful action on the part of Virginia.
