It does not matter that Mark Kelly used his money to buy the AR-15. When he was caught on camera buying it, he probably made up the story about giving it to the Tucson Police. When he made that statement, he just indicted himself as a “straw man” purchaser. Although he was the actual purchaser, he admitted that the firearm was not for his personal use and it would be given to a third party. In so doing, he LIED on the Form 4473 and committed perjury. If you or I did this, the ATF would be throwing us in the federal slammer so fast it would make our heads spin. But, because Kelly is Gabby Gifford's husband [with the attendant sympathy attached to her shooting], he gets a "get out of jail" pass. Hypocrite!

The instructions say to answer yes to 11.a if you are buying it as a gift, same as if you intended to keep it/use it. Not a straw purchase. Let's go after him for being a hypocrite, but the gift issue is a non-starter.
