Top IRS official will invoke Fifth Amendment

WASHINGTON – A top IRS official in the division that reviews nonprofit groups will invoke the Fifth Amendment and refuse to answer questions before a House committee investigating the agency’s improper screening of conservative nonprofit groups.

Lois Lerner, the head of the exempt organizations division of the IRS, won’t answer questions about what she knew about the improper screening – or why she didn’t reveal it to Congress, according to a letter from her defense lawyer, William W. Taylor 3rd.

Lerner was scheduled to appear before the House Oversight committee Wednesday.

“She has not committed any crime or made any misrepresentation but under the circumstances she has no choice but to take this course,” said a letter by Taylor to committee Chairman Darrell E. Issa, R-Calif. The letter, sent Monday, was obtained Tuesday by the Los Angeles Times.

I don’t think a lawyer would advise a partial 5th. The reason for the 5th in this case is likely to obtain immunity.

I believe that the official advisement that the 5th is going to be claimed is the expectation that those seeking her testimony will agree to immunity in advance. My guess is she has something of value that her attorney believes will result in an immunity deal.

However this plays out, this is not a good development for Obama.

Well, my post brought back to me those cases. Here, briefly, is one:

It was raining and approaching dark and a dilapidated house trailer had broken down on a county road just around a corner. The trailer mover truck driver had driven off and left it. Our constable, a Republican, had to do something to get that off the road. He called the county commissioner, a Republican, and the commissioner himself drove a front end loader to push it off the road before someone crashed into it coming around the corner. Naturally, the pushing off the road did some damage to the old trailer.

The brought in lawyer got the grand jury made up of the District Judge's relations and friends, to indict them on a charge of intentionally committing a HATE CRIME by damaging the trailer. The owner of the trailer was black. The lawyer contacted the press from Houston and there was the press at the jail to see the two “criminals” taken to jail to make bail. They actually had to go to trial and were found not guilty. This story is as ridiculous as it sounds. The other cases were just as ridiculous.

Shulman was initially a Bush appointee, but technically he was an Obama appointee. When Bush left office, all political appointees must submit their resignations. Shulman was reappointed by Obama since he did not accept his resignation.

Shulman made a contribution to the DNC in2004 of $500. He is probably a Democrat.

When I was dealing with those court cases in our county with the Democrat District Judge, I conferred with one of our lawyers about taking the 5th in that grand jury. I was told if you take the 5th, it must be total. You can't pick and choose questions. You must take it for every question.

I just heard about the rallies a few days ago and walked to the local IRS several blocks from my office arriving at about 10 of 12.
There were 8 people there. No organizers or anything like that. Just some of us that heard about the plans. Within a few minutes there were at least a dozen. Mostly we were all strangers to each other. By the time I had to go back to work the number had doubled and was growing. People came and joined. Just like that.
We chanted a few chants that we made up.
There was a couple of DHS uniformed cops taking notes. I held up my sign to them a little closer to make sure that they could read it.

INTIMIDATE
RIVAL
SQUAD

While we chanted “intimidation through taxation”.

Taking the Fifth Amendment is considered an admission of guilt by most people, that's just the way it is.

Republicans can use this if they're sharp.
Ask her who above her knew of her actions.
5th amendment of course.
Then ask her if the White Hut or OBozo ordered her actions.
Let her take the 5th on that.

Stir up a hornets nest.
Let the innuendos fly for questions she won't answer.
Play the game ruthlessly on the bastards, play to win.

If she takes the 5th, she obviouly knew her actions were criminal.

Maybe, but she may be taking the fifth to cover for Obama. Whatever she's convicted of, she knows Obama will pardon her and then his lib friends will get her some high paying cushy job at a university or a think tank or in the media.
