They had to shop judges-actually Magistrate to get it approved. Their first attempt failed when a Judge refused. So they tried another.

I also think the the Judge that oversees these magistrates name is Judge Royce Lamberth (sp?)

That was proven when Holder was found guilty of Contempt of Congress. It will be referred to DoJ for prosecution. What happens after that is rather predictable.
