Judge orders girl added to adult lung transplant list

A federal judge on Wednesday ordered the U.S. Health and Human Services Secretary to suspend existing organ allocation rules to give a 10-year-old Pennsylvania girl a better chance at a life-saving lung transplant.

U.S. District Court Judge Michael Baylson told Kathleen Sebelius to direct the Organ Procurement and Transplantation Network, or OPTN, to make an exception to the so-called "Under-12" rule as it applies to Sarah Murnaghan, who has end-stage cystic fibrosis, for at least 10 days, until a hearing on June 14. That move means that the girl can be considered more quickly for organs as an adult, instead of being limited to the pediatric transplant list. 

The ruling, which grants a temporary restraining order, applies only to Sarah, although Baylson indicated that he would consider a similar move for another child in Sarah's circumstances, if a family presented the case in court.

Yes, I am not comfortable at all with how this is moving...though I understand the girl was at the top of the pediatric list for a transplant at this hospital...where there are children just as sick as she is.

My understanding is this only allows the girl to get on the “Adult” waiting list....but would seem she would then go at the bottom of that list?

At any rate this isn’t something I’m celebrating either....will someone get “bumped” because of all the media attention and involvement of the government?

And this now will encourage other parents fighting for their children to seek media attention...so then does the media determine to run or not with their story?

In the near future patients, before undergoing any medical procedures, will need to get clearance from their IRS Medical Agent that their income taxes are up to date.

every tranpslant involves a winner and a loser

question is who is more likely to live another 50 quality years with the lung, this 10 yr old or a 50 yr old?

My question is, who is going to die instead of this girl, if she gets their lung?

The 'Titanic Effect'...men gave up their spot in the lifeboat for women and children. It used to be that an adult would gladly give their life to save a child. Now in America?

Not so much.

I understand it’s more about how an adult lung will survive in a child.....and how long....will she need another as this lung ages should she get one...and then there are further complications because it is an adult lung being used. Apparently the success rate isn’t near as favorable and likely why they set the age limit.

They are elected and they are experts in the field. But you think an appointed federal judge should substitute his non expert opinion in place of their expert one.

NO, I am saying the government, courts and ELECTED (read partisan) people have no business making these decisions.

BTW, I would trust anyone with "UN" in their acronym, especially under contract with the feds.

you don’t know that

the age for an “adult” transplant is 12 and she is 10 and looks pretty big, but puffed up, maybe steroids

the criteria ought to be recipient size weight and other medical conditions that make the transplant viable, not merely age

if the kid wanted an abortion HHS would be defending her in court, not fighting her

They have separate child and adult lists for a reason, a sound medical reason.

I suspect now they will now write the criteria up expressed more complexly as a minimum chest volume or capacity rather than the easier to understand and apply age criteria at their next meeting.

Or both, must be age 12 or have a chest volume of X size to qualify for an adult lung.

And in a possibly related matter. . . who is willing to bet that (1) this would have been a MUCH different story if the parents were Obama donors, and/or (2) the parents will turn out to have donated to one or more Republican and/or Conservative causes. . .

That’s what I’m hearing as well...thus I’m not comfortable... it appears someone else was pushed off for her to be put on the list...now she’s on two lists which certainly isn’t fair to other children...nor adults waiting.

Krauthammer said the same thing..This should be a medical, scientific decision..not government.

I would do the same thing the parents are doing if it were my child, but as a society we have to make decisions...hopefully, the doctors and scientists are making decisions based on ethics and compassion as well as what are the odds for each patient.

I wouldn’t want the govt to make those decisions.

But she's now on two lists which doubles her chances over other adults and children.....if my child was equally as ill...which I understand there are other children in that hospital as ill as she is....I would be fuming!..

How about a "transgender"? See where the politics would come in and why the government doesn't belong in this discussion, let alone have the power to decide?
