Don’t be surprised if a literacy test in the near future is deemed discriminatory, for just that reason.

Several companies are currently being sued by the NLRB for asking about arrests on their applications because of higher arrest rates for blacks.

The way we are going it won’t be long until private employers must list all job openings with the US Department of Labor. Department civil servant, in consultation with the appropriate union, will send the company a government vetted individual to fill the position. Employers will not have any discretion in hiring or firing.

Of course employers will be held liable for any acts of the employee while on the job.
