It’s not the Judge that decides; it’s the Jury.

the judge allowed for a verdict of manslaughter even though he had never been charged with manslaughter. The request came from the prosecution as a last gasp to please Soetoro. A ruling of guilty of manslaughter would have been the judge's verdict.

And, don't forget the charge of "child abuse" because TM was 17.
