Federal court rules for EPA in Texas suit over greenhouse gases

A federal appeals court sided with the Environmental Protection Agency on Friday in its ongoing dispute with Texas and Wyoming over reducing greenhouse gas emissions.

The decision amounts to a defense of the federal Clean Air Act, which has faced repeated challenges from Texas, the nation’s leader in greenhouse gas emissions.

In a 2-1 vote, a three-judge panel of the U.S. Court of Appeals in Washington ruled that the states — along with various industry groups — did not have standing to sue because they could not show that they had suffered an injury or that a ruling throwing out the EPA plan would benefit them.

Federal environmental regulators have required states to include greenhouse gases when issuing pollution permits since 2011. Texas didn’t want to comply, and the EPA took over its permitting program.

The case began when state officials sued the EPA to prevent it from taking control of the state’s regulation of carbon emissions.

The EPA has said that greenhouse gases are a threat to public health, and some scientists have linked them to global warming. But Texas officials have been skeptical and said curbing greenhouse gases could cost state businesses and homeowners and could jeopardize jobs.

In Friday’s decision, Judge Judith Rogers said the Clean Air Act clearly says that states must issue permits “for each pollutant subject to regulation under the act.”

Cyrus Reed, conservation director with the Lone Star Chapter of the Sierra Club, said the ruling will lead to a reduction in greenhouse gas emissions and carbon output.

I respect that Abbott is willing to at least try. Better than most other state AGs in that respect. But maybe he does need outside pro counsel...

The courts have long been arrogant but this is the current vogue in judicial activism: claiming citizens and states don’t have standing to challenge laws. Dear judges: if not the people, then who exactly is to challenge tyranny?

Excuses! Excuses! Excuses! According to your argument, let’s just throw in the towel and let Obama become the dictator of the USA. And when Abbott files an anti-Obama as dictator lawsuit, you can count on him to lose. Texans needs a more effective leader to oppose the Obummer White House. Filing frivolous lawsuits just isn’t good enough.

But it’s costing millions of dollars of Texans taxpayers’ money to file frivolous lawsuits. Perhaps that money could be better spent on education, roads and water for Texans.

Texans deserve a true fighter for the Lone Star state, not a faux fighter. Results are what matters. Just because Abbott’s says he’s going to fight for Texas doesn’t mean it’s true.

Does it make any difference at all that there has been no statistically significant “global warming” for approximately 17 years now... as measured by both ground based reporting stations and satellite data? This lull has happened despite rising levels of CO2 in the atmosphere.

Of course climate change is a fraud, but Abbott was in charge of fighting these fraudsters and look what happens? Eco-activists start winning cases in court. This is a case where Abbott causes more harm than good for Texan companies.

There you go! I like that idea. Why do the states comply with ridiculous edicts?

Someone needs to force the EPA to explain why they classify a naturally occurring gas (CO-2) that is necessary for life on the planet is a “Pollutant.” Absurd, but then the Dumbies truly have taken over.
