I see that it was a 2 to 1 decision of the Third Court of Appeals, with Chief Justice Jones dissenting. Is that the end of the matter, or does the State of Texas have a right to appeal to the Texas Court of Criminal Appeals (the highest Texas court for criminal matters)?

An article in Slate (!) says that there could be further appeals.

They also include Tom's smiling mugshot.
