If he ticketed me he had better be prepared to show up in court and swear under oath how he could magically see into up into my SUV from sitting much lower in a patrol car and be able to tell through my tinted windows in the couple seconds he was beside me that I had a phone in my hand as opposed to another dark object such as a wallet or eyeglass case and I was using said phone to text as opposed to simply holding it.

All he has to do is get a copy of your cell phone records, which will document the date and time of your activity on the phone, if you were on the phone.

If you were not on the phone, the charges would be dropped.

Trust me, having worked in the legal field for 15 years, no law enforcement agency is going go through the time and effort of getting a subpeona for cell phone records for a $100 traffic violation....

The cop doesn't even have to go that far. He will simply lie in court and the judge, who is also part of the revenue system, will take his word over a citizen every time.
