If it's a 'Pellet Rifle' it's not a "toy", if it's an 'air soft rifle', that's another matter, it is a 'toy'. However, the 'rifle in question' sure looks real enough.

But 10 seconds?..doesn't sound like a lot of time -- until you count off ten seconds, it could feel like an eternity. Plenty of time to lay it down or put hands up. And sorry, but age is irrelevant. Plenty of 13yo 'kids' who are seasoned gang-bangers today.

Good also feel darn short if you didn't hear or see the police officers and are trying to figure our what is happening behind you. Not saying that is the case, but certainly a possibility.
