Sadly, young Mr. Lopez wasn’t carrying two trumpets when he drew the attention of the patrol deputies. He WAS in possession of a replica firearm (as defined by the CPC Section 12550), and openly carrying it in a public place, (a violation of 12556 CPC), when, according to the deputy’s acccount, he turned, with the muzzle of the AK replica turning in their direction.
Tragic, without question.
However, one might also question a parent who allows his teenage son to walk down a public road carrying what photographs published right here on FR appears to be a very convincing rendition of an AK47, in violation of both the law and common sense. There was certainly negligence in this case, but on the part of the parents, not the deputies.
-Not a big second amendment fan are you? You're going to be very surprised when you find out that things didn't quite play out exactly the way officer Gelhaus says they did. The bullet wounds tell a different story. One witness says that Gelhaus kept firing even after this kid was falling to the ground.

-Yes, I agree,that was DUMB,especially in light of today's trigger happy cops, shoot a dozen rounds first and then take a paid leave of absence to fill out reports. It was his friends air soft gun. But again, your total acceptance of Officer Gelhaus putting 7 holes in a 13 Y/O kid who is about 5 foot tall is revealing how far this society has slipped into acceptance of a police state. How many plastic pellets was it that the Lopez kid fired at Officer Gelhaus, again?
