A Chattanooga, Tennessee mom is suing Hamilton County Schools after it was discovered that Apison Elementary School was strip-searching her five-year-old special needs daughter on a daily basis without her consent.
The young girl with special needs was diagnosed with congenital herpes while attending school, and despite being given consent to return to school by a doctor, school officials decided that they needed to check to see if the child had legions. So, for a few weeks, a school nurse would check the young girls body to make sure there werent any new outbreaks.
The girls mother, Brandy Madden, says she later found out about the strip search and has decided to file a lawsuit against the district because she never gave consent to the search. Madden is suing for all medical expenses, past and future, and says that the unwarranted searches caused emotional distress, suffering, and embarrassment.
The school has responded, however, claiming that the young girl, who has special needs, still wears a diaper at five years old and that the searches only occurred when the nurse changed her diaper. The statement claims that the girl was, unable to self-toilet and was therefore dependent upon school officials to change her diaper.
This child had a diminished expectation of privacy such that any routine examination that school officials may have conducted during the course of routine diaper changing would not have violated any clearly established rights of the child, continued the school in their statement.
Madden also claims that she lost her job due to missing a number of workdays in order to deal with the situation. The lawsuit is still unresolved.

I seriously agree. It’s indoctrination and propaganda, and the farthest thing from real education you can get.
Whoops! Turns out that congenital herpes is a thing. It’s what they call it when the mother passes herpes to the baby as the baby is being born.
In this instance, I side with the school. When I first saw the headline, I pictured something far more public, for more unwarranted. The school has just cause to make sure, damn sure, that there have been no new outbreaks in order to protect the staff and the other students. There is an appropriate opportunity given them to have a health care professional, a nurse take a look. This is not like have a teacher publicly shame a student in front of their peers. The school stumbled in that they did not obtain permission from the Mom first. That was wrong. They may need to look at the enrollment forms and be advises by legal counsel who says the parents have already given ‘tacit or implied permission to insure the safety of their child’ by virtue of the parents signing an agreement on School Policy. That may be there only way out. The mother loves her daughter, for sure, but the school is not her enemy in this case.
*If* the facts are as presented, the school’s case is lock tight....in spite of the spelling/grammar challenged author of the piece.
My SIL has worked for 30 years as a special needs teacher for just this type of child. I’ve heard a lot of stories about some of the parents. Money tree is likely a good guess.
Now, that said, my dealings with the public school system demonstrated over and over that they are congenital liars and will lie for convenience even with the truth will do just fine.
I would hope so, but I see nothing here to automatically justify that assumption.

The child has herpes for life, is still using a diaper at age 5, likely has many other forms of physical and developmental retardation, and the mother is looking to sue the school for all past, present and future medical expenses.
Just put the mother in jail and place the child with the state. Better for all concerned.
The fact she lost her job tells me she thinks she has a chance of winning this lottery and used it as an excuse to get fired (unemployment).
Congenital herpes also tells me quite a bit.
Maybe the mother was consorting with the Tenth Legion, or perhaps the French Foreign Legion.

It’s at the point that ya’ gotta look at conservatives complicit in filling the public schools with their own kids.
It’s tough, I know, but God help us if we can’t rescue our own.
You would be surprised how many freeper think their local public schools are “different”.

years ago my wife worked in daycare. In just a few months she identified 4 children who had been raped while changing their diapers.
The youngest was about 9 months and the oldest was a 13yr girl with downs syndrome.

A 5 yo retarded kid that isn't potty trained is VERY retarded and has surely gotten used to other people changing her diapers. And how is a responsible person supposed change her diapers without checking for the lesions? One would think the mother would want that done. It's like saying you are supposed to wipe the poop off her butt, however you can't touch her while doing it.

Could be an adoptive mother. Benefit of the doubt. Adopted a special needs child.
Or she could be a money-grubbing slut who didn’t seek pre-natal care because she didn’t care. Truth somewhere between probably.
16% of people of child-bearing age have genital herpes. If the mother has active lesions at delivery, she should have a C-section. If there are no active lesions, there is less than 1% chance of the baby being infected according to the CDC.
