Judge strikes down Florida law mandating drug tests for welfare

A U.S. judge on Tuesday struck down a Florida law requiring drug screening for welfare recipients, saying that it violated the constitutional protection against unreasonable searches.

Florida Governor Rick Scott, a Republican who campaigned on a promise to expand drug testing, said he would appeal the ruling.

The law took effect in July 2011 and required parents to undergo and pay for urine tests for illegal drugs when they applied for Temporary Assistance for Needy Families, a federal-state program that helps poor people with children pay for food, shelter and necessities. …

I disagree with the decision but I actually can see the judge’s reasoning. Something which I usually can not even guess where it came from.

The decision implies that one has a right to governmental handouts.

It implies that the government cannot place conditions on how it hands out the largess stolen from its free citizens.

It is highly apocryphal.

To hell with that. Ignore the black-robed tyrant's outrageous ruling and enforce the law anyway. These courts are way out of line. They can declare anything to be constitutional or unconstitutional on a whim.

Good point. But you see you don’t have a right to the money you earn; the lazy do have a right to the money you earn.

Although this was mentioned earlier, in order for me to earn the money that the lazy have a right to I have to get tested. But if I become a leech on society then I won’t have to....

Bahahahahaha! Since when does the FEDERAL government give two hoots about the 4th Amendment? What *possible* logic can this judge be using?

You cannot perform unreasonable searches on people just because you give them money. So, like, if we get federal money, the NSA, FBI, CIA, DHS, BATF&E, etc., cannot conduct unreasonable searches on us?

But if they get welfare handouts, *it’s just not right* that the state can ask them to prove they are not misusing that money to buy drugs.
