Midshipman in Naval Academy sex case not guilty

A former Navy football player was found not guilty of sexually assaulting a fellow midshipman at an off-campus party nearly two years ago.

A military judge, Marine Corps Col. Daniel Daugherty, found Midshipman Joshua Tate not guilty on Thursday morning at the conclusion of a court-martial at the Washington Navy Yard.

Tate was facing up to 30 years in prison if he had been found guilty.

Tate also was charged with making false statements to investigators three times. Daugherty sent those charges back to Naval Academy Superintendent Vice Adm. Michael Miller for reconsideration. As commanding officer, Miller has the final say on whether to prosecute under military law.

Daugherty said Wednesday that two other midshipmen accused of lying in connection with the case ultimately were not prosecuted in court and were punished administratively at the academy instead.

This was she said/they said the whole time. She couldn’t even remember anything.

It was recommended that none of this go to trial, but under pressure from female Senate DEMs - the poor guy had to endure the court-martial.

No, another fine young midshipwoman who got so bombed that she had sex with this young man in his car, and then can’t remember a thing the next day. If someone hadn’t told her about it, she said she would have never known. REALLY??? So glad that this idiot is in a service academy - she should really have a good time when she is on a sub or aircraft carrier for six months. I would have booted her arse for being such a drunken liar, but then that’s the ol’ dinosaur talking.

she was too drunk to know....she found out thru social media and then confronted this creep who stated that YES they had sex while she was out of it...its called RAPE/RAPE....

she was grilled for 20 hrs by three defense teams which has so outraged the Congress that the rules were changed....no longer will the victims be subjected to worse interrogation then the perps....

but no surprise...the male military estbablishment protecting some of their specially protected football players with ethnicity....

like the lawyer said, there's a reason most rape cases are never even reported by victims...its like being attacked again, except its all public...

Not really....they want preference is what they want

If they wanted equality they would be treated same as a man in a rape case

I don’t know facts in this case and will take your word for it but altering rape law over and over and over long ago put falsely accused men at disordinate risk as a consequence

I have seen....with my own eyes...in the 70s a girl partying on quaaludes decide to gang bang 4-5 guys

You cant win this argument for the same reason Sarah Palin doesn’t have a prayer of being elected president. Women are light years behind all other groups when it comes to equality. You will see a hispanic male president, an asian, an american indian,an east indian and every other group before you will see a woman president. The prejudice is astounding.

I would boot all their butts for abhorrent conduct. The women who think they can drink as hard as the men and fool around with them, up to and including sex, should shut their pie holes about “abuse” because they are into it up to their stupid necks. I am sick of this crap. There are conduct rules, and they need to be enforced across the board. Any woman who gets so bombed that she doesn’t know what she is doing is unfit, and same goes for the men.

Sorry to be mean, but the female midshipman will be sought after as a general's/admiral's "aide".

I'm with you: the taxpayers are paying over $300K to educate academy cadets. I think we deserve better behavior for that investment.

I was no saint in college, but we didn't allow our female friends to be taken advantage of. But that was a long time ago.

I was no angel in college either, and I attended some pretty wild parties at air force bases. I never drank so much that I didn’t know what was going on or what I was doing, and no one ever tried to “take advantage” of me beyond what I would allow (which wasn’t much back in the ‘60s). The military can keep pushing that there are no differences between the men and women, so the unnatural result of that false assumption is what we see in this story.

I'll say this for my alma mater: it prepared me very well for the rigors of living in Germany for four years.

There's another point, IMHO, that has to be stressed: as an officer, you CANNOT place yourself in a compromising position.

There is no way I'd want any of these midshipmen in leadership positions. As a platoon leader, I enjoyed having a few beers with my soldiers...but I never got $hit-faced (except during our tour of the Konigsbacher brewery, and we had a designated driver).

If the young lady graduates from the Naval Academy, her history will be known from the moment she arrives at her duty station. Gee, I wonder how that will turn out?
