U.S. Supreme Court upholds Michigan's ban on affirmative action in college admissions

The U.S. Supreme Court upheld Michigan's controversial ban on affirmative action in public college admissions in a divided opinion released Tuesday morning, preserving a status quo that's contributed to dwindling minority enrollment at the state's flagship colleges.

The high court's decision is a blow to the University of Michigan in Ann Arbor, which has come under fire for low minority enrollment.

Blacks comprise just 4.6 percent of undergraduates this year, compared to 8.9 percent in 1995 and 7 percent in 2006.

University of Michigan President Mary Sue Coleman and admissions director Ted Spencer have decried the affirmative action ban, saying outright that the school cannot achieve a fully diverse student body with it in place.

"It's impossible," Spencer said in a recent interview, "to achieve diversity on a regular basis if race cannot be used as one of many factors."

Fifty-eight percent of Michigan voters in 2006 passed Proposal 2, a ballot initiative that amended the state constitution and made it illegal for state entities to consider race in admissions and hiring. With the Supreme Court's ruling, the only way left to nullify Proposal 2 is to mount a long, expensive and uncertain campaign to overturn it.

The appeals court decision that led us here was insane. They said that BAMN was too poor to win so they should win because they were poor.

The really good news is it was 6-2.

That is good.

Probably would have been 6-3, if Kagan didn't have to recuse herself.

Sotomayor's dissent was apparently a pile of convoluted nonsense regarding the different ways to change policies.

Agree. It ignores the “why” black students aren’t qualified in the first place. It is racist to say it is impossible. The underlying factor is the generational decay of family values in these communities. They’re perfectly capable human beings but so long as we celebrate the pop-culture that preaches harmful messages to our young there will be no change. For liberals, the “fix” is to admit unqualified candidates and force a system to “produce” minorities with a degree, which just lowers the standard and makes having a degree meaningless...which is unfair to those that graduate with meaningful knowledge.

b) Why is it “impossible”? That statement sounds racist to me, as it assumes that students of certain “races” are inherently inferior and unable to compete.

Exactly!

“This case is not about the constitutionality, or the merits, of race-conscious admissions policies in higher education. Here, the principle that the consideration of race in admissions is permissible when certain conditions are met is not being challenged. Rather, the question concerns whether, and in what manner, voters in the States may choose to prohibit the consideration of such racial preferences...

...Unlike the injuries in Mulkey, Hunter, and Seattle, the question here is not how to address or prevent injury caused on account of race but whether voters may determine whether a policy of race-based preferences should be continued. By approving Proposal 2 and there-by adding §26 to their State Constitution, Michigan voters exercised their privilege to enact laws as a basic exercise of their democratic power, bypassing public officials they deemed not responsive to their concerns about a policy of granting race-based preferences.”

Without affirmative action, where will the Racist Studies program, or the Gay/Lesbian Studies programs get their students?

Kids might want to study Engineering, or something, instead, and that simply cannot be allowed.

Kennedy, Roberts & Alito delivered the opinion. Scalia & Thomas had a concurring opinion, as did Breyer. Sotomayor and Ginsberg dissented.

Amen. Really good news. Maybe now we can start to restore the great Universities we once had. It was a six two decision as well a good solid majority.

No mention of Asians and their representation, which exceeds their percentage of the population.

Although University of Michigan freshmen enrollment decreased slightly this fall, the Ann Arbor campus enrolled more graduates and undergraduates than ever before.

Total enrollment at the university is 43,426, a 1.7 percent increase that marks the largest student body in university history. Overall, there are 27,979 undergraduates and 15,447 graduate students.

Underrepresented minorities make up 10 percent of the freshmen class, a 0.5 percent decrease from 2011 and a 0.6 percent decrease from 2010.

Overall, there are 2,207 blacks, 1,785 latinos, 442 Native Americans and 81 Hawaiians and Pacific Islanders enrolled. At 5,689 students, Asian Americans, who are not considered underrepresented, make up 13.1 percent of the school's total student body.

This year 13.5 percent of the student body —5,881 students— are considered international, an increase of roughly five percent from last year.

U-M first- and second-year undergraduate tuition this year is $12,994 for Michigan residents and $39,122 for out-of-state students.

“It’s impossible,” Spencer said in a recent interview, “to achieve diversity on a regular basis if race cannot be used as one of many factors.””

A rather backwards admission that the black-IQ gap shown in “The Bell Curve” is a cruel reality.

I don’t get why the Supreme Court would uphold this ban yet say that discrimination in other cases is ok.

Is the point to achieve diversity or to educate those that are capable of learning and will be an asset to our society?

These liberals have the wrong goal. As usual.

Obviously most of us voted for the ban.

Racial preferences is regressive and backward. True affirmative action means accepting the best and brightest students without consideration of their race.

I have been wondering about why Whites are racists and no other race is......

Michael Richards makes his point...Michael Richards better known as Kramer from TVs Seinfeld does make a good point. This was his defense speech in court after making racial comments in his comedy act. He makes some very interesting points...

Someone finally said it. How many are actually paying attention to this?

There are African Americans, Mexican Americans, Asian Americans, Arab Americans, etc. And then there are just Americans..

You pass me on the street and sneer in my direction. You call me ‘White boy,’ ‘Cracker,’ ‘Honkey,’ ‘Whitey,’ ‘Caveman’... And that’s OK...

But when I call you, Nigger, Kike, Towel head, Sand-nigger, Camel Jockey, Beaner, Gook, or Chink .. You call me a racist.

You say that whites commit a lot of violence against you.... So why are the ghettos the most dangerous places to live?

You have the United Negro College Fund.

You have Martin Luther King Day.
You have Black History Month.
You have Cesar Chavez Day.
You have Yom Hashoah.
You have Ma’uled Al-Nabi.
You have the NAACP.
You have BET....

If we had WET (White Entertainment Television), we’d be racists.

If we had a White Pride Day, you would call us racists.

If we had White History Month, we’d be racists.

If we had any organization for only whites to ‘advance’ OUR lives, we’d be racists.

We have a Hispanic Chamber of Commerce, a Black Chamber of Commerce, and then we just have the plain Chamber of Commerce. Wonder who pays for that??

A white woman could not be in the Miss Black American pageant, but any color can be in the Miss America pageant.

If we had a college fund that only gave white students scholarships... You know we’d be racists.

There are over 60 openly proclaimed Black Colleges in the US .. Yet if there were ‘White colleges’, that would be a racist college.

In the Million Man March, you believed that you were marching for your race and rights. If we marched for our race and rights, you would call us racists.

You are proud to be black, brown, yellow and orange, Homosexual, Lesbian and you’re not afraid to announce it. But when we announce our white pride, you call us racists.

You rob us, car jack us, Rape and shoot at us. But, when a white police officer shoots a black gang member or beats up a black drug dealer running from the law and posing a threat to society, you call him a racist.

I am proud...... But you call me a racist. Why is it that only whites can be racists??

There is nothing improper about this e-mail.. Let’s see which of you are proud enough to send it on. I sadly don’t think many will.

BE PROUD TO BE WHITE!

Sotomayer’s dissent can be distilled down to “the Constitution requires affirmative action so voters are not free to forbid it.”

This fat lesbo, er “wise latina” is beyond a political joke.
