Supreme Court Upholds Michigan's Affirmative Action Ban

"Our state Constitution requires equal treatment in college admissions, because it is fundamentally wrong to treat people differently based on the color of their skin," Republican Michigan Attorney General Bill Schuette said. "A majority of Michigan voters embraced the ideal of equal treatment in 2006, and today their decision was affirmed."

...

Justice Sonia Sotomayor, joined by Justice Ruth Bader Ginsburg, filed a 58-page dissent and summarized it from the bench—a signal that the court's minority strongly disagrees with the majority.

Justice Sotomayor wrote that Michigan voters "changed the basic rules of the political process in that State in a manner that uniquely disadvantaged racial minorities." In order to obtain admissions preferences, they now would have to amend the state Constitution, she wrote, while other groups—such as alumni children or athletes—could obtain admissions preferences more easily, such as by lobbying university regents or administrators.

Justice Elena Kagan recused herself from the case, likely because she had been involved in the case in her prior post of U.S. solicitor general.

"decades ago"

Back in the sixties it was a firm belief of most media types, who were just as liberal as they are now, that the only reason minorities weren't represented in many jobs proportional to their numbers was racism and discrimination. Fifty years later we know the truth...unless standards are lowered, a very high pct. of minorities are not as competent as non-minorities.

The truth is (as always) a very difficult thing for libs to face. One of the worst things to happen to this country is people artificially elevated to positions/work they are unqualified to perform. Hopefully, this decision helps end the madness.

"Does the Equal Protection Clause of the Fourteenth Amendment forbid what its text plainly requires?"

Only on this planet...

My favorite statement printed at the bottom of most corporate HR documents and websites, “XYZ Company is a Affirmative Action/Equal Opportunity Employer.” Huh?

No, it means their arguments are so weak that it took 58 pages of bs from the "wise Latina" to try to come with a dissent that might sound plausible.

No no no no. It isn't minorities being targeted.

It is whites being targeted, and that will not stop just because they may become "minorities."

This is about holding the whip hand and that continues until the final solution...

look at the world and think

I didn’t say whites were being targeted. If you read what I wrote you and I are on the same page.
