I’d be suspicious here. Are there any financial incentives for the trustees to find doctors who will “find” Mr. Sterling to be incapacitated? I call BS and if this were my family, I’d consider a lawsuit for elder abuse.

So it sounds like the immaculate and revered NBA may have jumped the gun and bullied a sick old man. I would love to see the sale of the team get tangled up in court for years. Just because.

I think your mother’s doctor is correct. I’ve had the occasion of taking depositions of many doctors that work with older patients. The most trained will confirm what your mom’s doctor says. A Doc worth his/her salt will say that since Alzheimer’s can’t be certain until after death, the proper designation before death is Alzheimer’s Type Dementia.
I think the NBA is opening a can of worms it doesn’t want to be in. I read an article in legal publications weeks ago that stated Sterling had retained 12-18 private investigators to dig into the lives/history/biases of other owners. If it bore fruit, Owners would be reluctant to take his property away. Especially since their own dirty laundry would be exposed.
Having put similar language in trusts, I can assure you that Sterling would still be able to institute legal actions to delay any sale.
