You could argue trespassing. The airlines and airport ordered him to leave the plane and he did not. Also as the senior officer he is in control of the passengers and basically held them hostage by refusing to return to the gate.

He obviously planned this action as he had to review the route and submit his flight plan, check current weather conditions and prepare his charts, etc. It's not like driving a taxi.
