Lois Lerner's Blackberry may hold smoking gun

No hard drive crash could prevent the release of the email revealing Lois Lerner’s attempt to persecute Senator Chuck Grassley for receiving an invitation because it was sent from her Blackberry (hat tip: Ed Driscoll). This immediately raises the question of what other emails may have been routed through her Blackberry.

You may recall that just a couple of days ago, IRS commissioner John Koskinen declared that he didn’t know whether or not she had a Blackberry. That convenient obfuscation is no longer operative.

Twitchy chronicles the Twitterverse’s reaction.

Let’s see what kind of accident Lois will come up with to explain the sudden disappearance or smashing of her Blackberry.

Doesn’t Blackberry have its own email server system, inaccessible to the user (and the IRS, and the IRS “backup” people)?

We already have many of her emails (1000s). Did they blank out the recipients? If not, we have 1000s of recipient names and addresses. Subpoena all emails from L. Lerner that were received by those people, or sent to her by those people.

I’ll bet you’ll find lots of interesting material.

“YES”

Then subpoena that sucker. It would be hilarious to see the contortions that the IRS would go to try and block or view first and redact that!

I don’t know - is there something special about Blackberry emails? Because if they’re talking about getting what’s left on the phone, I think the chances of that are weak. What are the odds that an old Blackberry is still lying around? Haven’t most people moved onto iPhones or Droids?

The overriding question is---why would a federal agency w/ massive L/E powers----target Sen Grassley at all?

Consider that the vindictive lawless WH occupier went on jihad against Grassley for one reason. Sen Grassley was interfering w/ vote-crazed Oabma's plans to inundate America w/ illegal Democrat voters.

===============================================

American Patriot Grassley tried to protect Americans w/ his amendment to the Senate amnesty bill: "Congress should not thumb its nose at the millions of Americans who are victims of identity theft, often perpetrated by an undocumented person who steals Social Security numbers to get jobs, govt benefits, driver's licenses and more.

"This amendment would simply require the person applying for RPI status to disclose any previously used Social Security numbers," said Grassley. "It's the first step to helping clean up the mess that's been created for the victim of identity theft. The amendment also authorizes certain federal agencies, upon receipt of this information, to notify individuals who were the victims."

IS SEN SCHUMER COMPLICIT IN THE IRS/OBAMA CONSPIRACY AGAINST SEN GRASSLEY?: Dismissing Sen Grassley's proposal to protect Americans, Sen Schumer (Dem-NY) said: "When people are living in undocumented status, there are times, I suppose, when they've made up identities, made up Social Security numbers. How are they going to remember all that? (The) purpose of this bill is to bring people out of the shadows. We all know when they lived in the shadows, they had to forge documents, forge Social Security numbers, et cetera. I just don't see how, when you've lived here 10 years, and you've had many different identities, many different numbers, you're going to remember them all," said Schumer.

Subpoena her blackberry and the carrier.

Oh wait, that would require effort and cajones.

The "cover story" is that the invitations were plaaced in the wrong envelopes---and that Lerner "accidentally" received Grassley's invite. So that would mean Grassley got Lerner's invite. Right?

UT-OH Grassley put out a statement that he does not have Lerner's invite.

==================================================

As FReeper Fair Paul insightfully posted: How would Lerner receive an invitation that was meant to go to Senator Grassley? Is she intercepting his mail/email?

Lerner "accidentally" receiving....and opening ....US mail addressed to Sen Grassley is a federal offense----in legal terms: tampering with US mail. Mail tampering refers to the willful theft, destruction or opening of the mail of another person without their consent.

The moral equivalent of the Watergate break-in.

===============================================================

REFERENCE----mail tampering is a crime punishable by incarceration, fines, or a term of probation. Within these individual United States, tampering with the mail may be a crime under state laws; however, mail fraud is a federal crime. The exact definition will vary by jurisdiction, but "tampering" generally includes opening, destroying, damaging, or interfering with mail intended for another person.

Under most states laws within the United States, mail is considered private property. As such, an individual has an expectation of privacy attached to his or her mail. When another person breaches that expectation of privacy, he or she may be guilty of mail tampering.

State laws differ, but in most cases, no one is allowed to open mail intended for another person. In many cases, even members of the same household cannot open mail addressed to another person in the same house. State statutes do frequently make an exception for United States Postal workers or other carriers if they are acting in good faith when opening the mail as part of their job.

Destroying, damaging, or interfering with the mail are also often considered mail tampering. For instance, removing mail from someone's mailbox or throwing mail away that is intended for another person may amount to a crime. Under most state statutes, tampering with the mail is a misdemeanor and is punishable by a term of imprisonment of up to a year or two.

I’m probably naive, but I evidence of attacking a sitting senator may change everything. The GOPe love the Tea Party getting attacked, or at best, don’t care. But one of their own?

Actually, no. Her emails are on a Microsoft Exchange server system, the Blackberry has a server but it only routes the email through the Exchange server. It is not a stand alone mail server with its own database for storing messages.

How long are we into this investigation? 18 months? And there is STILL no smoking gun (which, if found, still doesn’t conclusively prove anything). Well done Daryl, Issa, well done. /s

That’s incorrect. The mails are only stored in the Exchange database. The Blackberry server logs in to the Exchange database with an administrator account for any access it needs to the mail system.

Can Congress subpoena copies from the NSA data storage files?

Would be interesting as these files could be the equivalent to the Nixon tapes! And the subpoena would comply with the Supreme Court Ruling.

Let’s stir the soup and set back and watch. Get the popcorn...

Or they accidentally stuffed two invitations into the same envelope. Not everything need be a conspiracy. There’s enough real crimes these guys have committed that we don’t need to invent new ones out of rampant speculation.

If it were her own, she would claim the 5th again, my guess. of course, if it were IRS property, she has no such defense available. Hummm, who also has a Blackberry (probably loves the name)??? The IRS probably has a contract with them.

BTW, my wife’s employer insists on using the Blackberry albeit most employees have migrated to I phones long ago and ignore the demand.
