The federal executive does have authority over the Texas Army National Guard and the Texas Air National Guard only when they are called into actual service of the United States.

Yes, but who can call the Guard into federal service? I think a law from 2008 said that only Congress can do so. Am I right?

When not in federal service the Governor is Commander-in-Chief

“He shall be Commander-in-Chief of the military forces of the State, except when they are called into actual service of the United States. He shall have power to call forth the militia to execute the laws of the State, to suppress insurrections, and to repel invasions.” - Tex.
