There is a legal truism that does apply, words never justify an assault.
My office prosecuted any number of A&Bs that were the result of someone being hit for what they said.
The court case has nothing to do with assault and battery. Ventura is claiming he was never hit.

But the suit isn’t about that. Ventura says Kyle never hit him and the book makes him out to be a wuss. He says that cost him money. I guess all that fake “wrasslin” added to his macho reputation.

Well, we need to write a new legal truism stating that it is legal, moral and justified to cold cock Ventura any time and anywhere that a Navy Seal feels like it. And, a $1,000 bonus to the seal should he kick Ventura in the cajoles while he’s at it. There, fixed your truism :)
Ah but this is a CIVIL suit and not a criminal incident. Ventura decided to sue Kyle’s estate because the a$%wipe didn’t like that Kyle said he smacked the old Jester down. Hurt V’s ego and pride so he has sued. Now he is getting what is his due

Which met the much older truism of "Don't let your mouth write checks that your azz can't cash." I believe the old beat the new into a pulp.
