Because Athiests, like a heck of a lot of other special interest groups, raise a lot of money and attract new members by being offended and having that offense noted and discussed in the press.
The Athiests probably don’t really care whether they lost this one; they managed to use the lawsuit and the courts to generate much more press than they would have otherwise had. So mission accomplished.
