Time’s Up for Lois Lerner and the IRS

On July 10, D.C. federal judge Emmet Sullivan gave the IRS thirty days to provide him sworn declarations in the Freedom of Information Act suit filed by Judicial Watch, seeking much of the same information the IRS has effectively kept from Congress. After an “extraordinary” hearing, Judge Sullivan ordered the IRS to tell him under oath exactly what happened to Lois Lerner’s hard drive. He demanded sworn declarations specifying what the agency had done to recover the thousands of emails missing. Time’s up.

The IRS filed its “declarations” yesterday. As an attorney who has read the filings and who has written extensively about this dedicated judge in my book Licensed To Lie, I could not in good conscience sign those filings. It’s not that they are false. Oh no, . . .each is very carefully worded to be literally true (hence, not perjurious). But, each says little, answers less, and reveals nothing that would actually lead to recovery of the emails or to anyone’s accountability for their disappearance in any form. In fact, the few pages say less than has already been revealed elsewhere.

Judge Sullivan may be quite impressed with IRS declarations—but not favorably. He’s the kind of judge who expects forthrightness and good faith, along with truth from the government. He wants to know what every citizen who gave any thought to the issues would want to know—real answers. Those emails have not disappeared. Remember, Emmett Sullivan is the no-nonsense and gutsy judge who held DOJ lawyers in contempt for their gamesmanship. He later named an independent special prosecutor of his own choosing to investigate the Department upon discovery that it had hidden evidence favorable to the defense in its corrupt prosecution of US Senator Ted Stevens.

Judge Sullivan knows better than to trust the government’s blanket,

What kind of email system is the IRS using?

We dont even know THAT MUCH yet???

If it is outlook (probably) and they have an EMAIL SERVER (also probably) then whatever happened to her hard drive is not relevant.

The emails come from server.

Prove this to yourself. If you have an outlook account go to a different computer and log on, your emails will still be there.

They also need to subpoena her Hotmail and Gmail accounts.

The government bureaucrats use a trick to get around the law. They create a free account on gmail (or wherever) and then SHARE the login informatiion with another user.

Then they create email messages and never SEND them to anyone, they just save as a draft. The other person just looks to see if there is any new ‘save as draft’ messages. They BOTH know it is illegal.

While the noose on the IRS has gotten tighter, I still have little expectation justice will be done. Lerner's hard drive "failure" was just too convenient and that seven other computers that might have incriminating evidence also just happened to conveniently "fail" screams obstruction of justice. Add to this that the IRS was in violation of federal records laws by not maintaining back ups there is every reason for IRS personnel should be fully prosecuted and serve serious jail time.

Remember Bush aide Scooter Libby? He was convicted of of perjury, making false statements to federal investigators, and obstruction of justice and sentenced to 30 months in federal prison and fined $250,000. Libby's supposed leaking of the identity of CIA agent Valerie Plame was largely trumped up and never reached the level of serious violations of law we are seeing at the IRS. If there were a Republican in the White House who had instigated such abuse by the IRS, the media would be howling for blood and the resignation of the President. Today its just crickets. We can hope that this judge is honest and committed to justice and Lerner and her ilk will get the jail time they deserve, but I am not optimistic.
