Gov. Perry stripped of his right to conceal carry and buy ammo

For those of you who’ve been sleeping since it happened Friday, Travis County grand jurors indicted Perry on charges of abuse of official capacity and coercion of a public servant. The first count carries a possible prison term of five to 99 years. The second, two to 10. I’m no expert on law or math, but I believe those potential sentences each exceed one year.

And there’s more. As an indictee, Perry’s state-issued Concealed Handgun License, assuming he still has one — his office didn’t know as of Tuesday afternoon — will be suspended until the case against him is decided. (Cue the cheering coyotes.)

The indictment’s impact on Perry’s gun rights was brought to my attention by a former Democratic state legislator who seemed happy to point it out.

“I’m surprised that you haven’t analyzed the most significant and immediate impact of the governor’s indictment,” ex-state Sen. Steve Carriker, D-Roby, told me in an email including the applicable federal law.

Carriker also was most helpful in providing the official federal “Firearms Transaction Record Part 1” form, which must be filled in by firearms purchasers. Question 11b asks “Are you under indictment or information in any court for a felony, or any other crime, for which the judge could imprison you for more than one year?” (An information is a formal accusation of a crime by a prosecutor.)

For Perry that’s now a big ol’ yes. And yes means no new guns or ammo.

Convicted Felons and Voting

In Texas, a convicted felon regains the right to vote after completing his or her sentence. Therefore, once a convict completes the punishment phase (including any term of incarceration, parole, or supervision, or completed a period of probation ordered by the court), the convict is eligible to register and vote in the state of Texas.

Is it Texas law that you cannot conceal carry because you have been charged with something not yet proven and not yet convicted for?

I wouldn't be surprised. There are thousands of people locked up in jails who have been "charged with something not yet proven and not yet convicted of."

You should be able to speak to post #111, given your professional experience. The 'ride' generally includes bond (cash) and agreeing in writing to certain restrictions?

He's the governor.

He absolutely has the legal power to pardon anyone he chooses, with no explanation whatsoever.

The drunk witch sort of forgot that part of the state law.

He can't pardon anyone without that pardon being forwarded and approved by a board.

Texas ain't the rest of the nation.

That, I'm ok with, and would support him if he did that.

He would be in violation of Texas law, though.

But he's in a better position to do that than I am.

I would prefer to see the law changed.

The Texas Governor really does not have a great deal of POWER. The Speaker of the House and Lt. Governor both wield more power at least when the Legislature is in Session!

Why would such a board consisting of sane adults not approve the pardon?

I am "all in " for Cruz, but honestly, as a life long Texan, I can say that Mr. Perry is an honorable man, and may be one of few leaders in this country trying to do something about dealing with the hoard from the south. He isn't perfect (i.e Gardasil), but I agree with about 95% of his agenda. Add that our state has a decent economy.....

Well, I think a little of your bashing of our governor is a little over the top. If you are a good Texan, contact your state rep and senator, and ask that they initiate or participate in legislation that will transfer prosecutory powers of the so called "public integrity" section from the Travis County DA's office, to the Texas AG where it belongs.

The law is in the Constitution. That’s what should be changed if these nazis don’t like it. Instead, they’ve cowardly instituted “laws” around the Law, which is God-given, and the only way it can be taken away is if it isn’t.

I'd be happy if the Supremes held NFA '32 and everything else after to be null and void.

I'm not holding my breath. I can make a difference at the state level.

I'm not bashing Perry. I support him in this, and have already spoken my mind to my State Reps (as if they didn't already understand my position).

I won't vote for him. He's a liberal at the core.

He may be honorable, and a great guy, but he's a lib, and I won't vote for him, ever.

Our upcoming new Lt. Governor Dan Patrick is hell bent on getting the Travis County DA's office out of the political witch hunting business. Now that Donehurst is out of the way, I am hoping 2015 will make it happen.

This event if one thing, will finally flush Strauss out as a RINO, especially if he tries to block legislation again.

And Perry has squat to do with the economy, except for cheerleading.

If you know Texas, you know the political power in the State has been with Dewhurst and Straus. I, along with MANY others, helped to get Dewhurst fired. Straus is next.

We've got a conservative governor incoming, with former AG Gregg Abbott.

Texas will do better with Dewhurst gone.
