You'd need to carefully define what constitutes serious scientific misconduct.
- To evolutionists, creationists conduct scientific misconduct just by daring to believe something other than the evolutionist dogma.
- The global warming advocates have many of the political realm snookered. They would gladly prosecute the global warming deniers, even though the science is against them.
- The same people who falsify scientific results are more likely to press false charges against their peers.
- A judge and jury would have to understand the science to be able to determine whether misconduct occurred. And they can be swayed by personal biases just as much as the next so-called global warming scientists.

Upon reflection it would appear that an effort to close one can of worms opens another much larger can while still leaving the first one open.
