I am very skeptical that there is such a thing as a “$25,000 Federal lawsuit”, but IANAL and I could be all the way wrong.
$25K is probably a tad over the filing fees for a typical (minor) Fed lawsuit. A $25K claim within a Federal lawsuit implies, to me, and again, I’ll happily stand corrected, gambling $15K-$20K in filing fees and probably $40K-$100K attys’ fees for a +$25K result, and yes, I understand that fees can be requested as part of a successful outcome...but to say “a successful outcome” in *any* litigation is unforeseeable is the understatement of the year.
Sounds fishy to me, that’s all. No attorney would advocate going into Federal Court for a $25K result.
In your favor is the fact that the Examiner is a far left loon rag, claimed to be more accurate than the Bay Guardian,....claimed.
If it’s an ADA issue then I believe the lawsuit is a Federal civil rights legal action, and the legal fees are recovered as part of a settlement in a case like that. You have a much better chance of recovering legal fees in a civil rights case than in most others.
