Parents May Be Liable for What Their Kids Post on Facebook, Court Rules

Parents can be held liable for what their kids post on Facebook , a Georgia appellate court ruled in a decision that lawyers said marked a legal precedent on the issue of parental responsibility over their children’s online activity.

The Georgia Court of Appeals ruled that the parents of a seventh-grade student may be negligent for failing to get their son to delete a fake Facebook profile that allegedly defamed a female classmate.

This opinion violates a basic precept that there shall be no responsibility without authority.

If parents are prohibited from disciplining their children they cannot be held responsible for the acts of the child. Parents may not spank, parents may not threaten children, parents are liable to be brought into family court at the instance of a child he was prompted to do so by his school.

It is wrong to strip parents of authority while imposing liability for the acts of a child whom they cannot control.

Very good point.

But if it’s the parents’ house, can’t the parents simply cut the internet wire to the kids room?

Interesting, isn’t it? For years I’ve monitored what my kids saw and posted online and felt “success” once they became legal adults (18) because it meant I didn’t have to monitor anymore, and that we survived that aspect of their childhood. My youngest is about to turn 17.

Naa, punish the kids too.

But I like the idea of punishing parents that refuse to control their kids and giving kids unrestricted access to the Internet is not controlling them.

So if parents choose not to step up to the job, then maybe we add a bit of risk to them and their retirement plans.

But that just supports what we (or you) don’t want...we don’t want no responsibility with these kids. We don’t want to blame parents or anyone else. These “kids” are practically adults (teenagers). They should be responsible for their actions.

I’m all for wanting parents to parent their kids. It used to be that way as well as kids being held accountable. Times have changed since the 70s and 80s and it’s all different now. However, I think teenagers should be held responsible for their actions. We’ve always had parents that didn’t “step up to the job” and we held those kids accountable.

I just think we (on both sides) keep perpetuating the dumbing down and babying of our youth.

Yea, I’m kind of taking a backhanded slap at today’s parenting. No matter how hard I try, I have yet to see why kids need 24/7 access to the Internet and to be on Facebook. I would agree that a cheap cell phone with voice capability is a good idea, especially now that pay phones are long gone. But I’ll keep working on it...there might a good reason yet.
