Fearing for his life, a clerk shot at two robbery suspects at a South Valley store on Monday night, according to the Bernalillo County Sheriff's Department.
One of the suspects [20 year-old Christopher Garza ]died as result, but the clerk is not facing any charges at this time. According to Sgt. Aaron Williamson, the other suspect, 20-year-old Ruben Lucero, has been charged with an open count of murder.
Sgt. Williamson said because the two men conspired to commit the armed robbery that led to the murder, Lucero will face the murder charge.
In addition to the open count of murder, Lucero is facing charges of robbery, aggravated assault with a deadly weapon and child abuse. Williamson confirmed a child was inside the store at the time of the incident.

Can’t say I blame the clerk at all. With locking the door and shooting out the camera, it sounds like they planned to kill him. I think he did the right thing. Saw this mess on the news last night and I thought it was good that the clerk did what he did.

The clerk did good and the lucky survivor is going away for a long time.
Outstanding. Dozens of unsolved cases cleared, hundreds of future crimes averted.
Make sure St. Gabby Giffords, and her trollish ‘husband’, know about this. I’m sure they’d rather the clerk had been disarmed.

The store had reopened Monday with a new owner and it was the first day of business.

Poor journalism but I think the clerk took a couple of shots at the car as it was driving away from the scene. Hope the cops can’t find evidence that the dead guy was hit by one of those bullets or else it’s a bad shooting.
“My aunt definitely saw two guys run out,” Josh Dunlap said. “The owner took about 3 to 4 shots.”
Deputies now tell News 13 the man who fired was the owner’s son.
“When they got in the car, he took about 2 to 3 more as they sped down the road,” Dunlap said.
