I tried to search the Archivist of the United States website to determine how many states have applied. As expected of most government sites, it was useless. Perhaps a more determined and skilled Freeper can find out.

If one reads about the last constitutional convention in 1787 one thing that's clear is the result may be quite different than anyone can anticipate. Fortunately (providentially), the Virginia delegation went in with a definite plan that formed a foundation for a viable national government. But even their program was substantially altered and improved through long drawn out discussion and a difficult series of tough compromises.

When someone brings up the idea of invoking Article V I always wonder what they hope or expect would come out of a convention that would be superior to the finely balanced original? And why do they believe the political class would obey a new constitution any better than one which has tradition, sanctity, and 225 years of proven durability and flexibility behind it?

I am glad you posted this as I was contemplating re-posting this: http://www.freerepublic.com/focus/f-news/2956489/posts from the day after the 2012 election. Since then, Levin’s book came out and while he calls for a lot more than I did, I still think that at minimum we ought to make the amendments I proposed.

I expect folks will show up here saying this whole idea is very bad.

Levin addresses several of the problems going on with D.C., but I fear that he doesn’t go far enough. I’d like to see amendments addressing the EPA (no regulatory authority without Congre$ional consent), the IRS (Flat or Fair tax), and an outright ban on Congressional or Executive amnesty for illegals.

The states need to amend the Constitution to give themselves the power to make punitive recall laws to get rid of bad-apple, federal lawmakers, federal executives and justices. The states can remove justices on a 3/4 majority state vote, just like amendments are ratified.

The states need to amend the Constitution to permanently move tax day (April 15) to the Monday before Election Tuesday, even in non-election years.

After the surprise ratification of James Madison’s 27th Amendment in 1992, Congress passed a law changing responsibilities for the various tasks of the amendatory process so that Congress would never be blindsided again. Bush signed it into law. You need to look that law up. I’m not completely sure the Archivist still has the responsibility of tabulating state petitions for an Amendments Convention. That responsibility may have been moved to the office of the Speaker of the House.

There has never been a better time to take out the IRS.

THE FAIR TAX WOULD BE THE BIGGEST TRANSFER OF POWER FROM DC BACK TO THE PEOPLE IN THIS COUNTRY’S HISTORY.

The FairTax is replacement, not reform. It replaces federal income taxes including personal, estate, gift, capital gains, alternative minimum, Social Security, Medicare, self-employment, and corporate taxes.

The FairTax brings jobs back to America by allowing companies to operate on our soil tax free rather than paying the current corporate income tax of 35 percent. Under the FairTax, various economists have predicted higher economic growth ranging from 7 to 14 percent over the current system, more jobs, and higher wages.

With the penalty for working harder and producing more removed, Americans are free to keep every dollar they earn, and a new era of economic growth and job creation is unleashed. Hidden taxes are history, Americans are able to save more, and businesses invest more. Capital formation, the real source of job creation and innovation, is facilitated. Gross domestic product (GDP) increases by an estimated 10.5 percent in the first year alone. The FairTax as proposed raises the economy’s capital stock by 42 percent, its labor supply by 4 percent, its output by 12 percent, and its real wage rate by 8 percent.

As U.S. companies and individuals repatriate, on a tax-free basis, income generated overseas, huge amounts of new capital flood into the United States. With such a huge capital supply, real interest rates remain low. Additionally, other international investors will seek to invest here to avoid taxes on income in their own countries, thereby further spurring the growth of our own economy.
