I’ve said they should take this to court, and this is exactly the grounds to do so.
Get an injunction, and then seek the ruling to bar this jackass from doing this unilaterally.

It would be better for a Governor (or Governors) to seek the injunction IMO. I think any could show cause for an injunction, and he could go straight to the Supreme Court.
Governors of states with a Dem Senator up for reelection in 2016 could nip this disastrous political ploy in the bud.
