Sheriff Joe Arpaio Files Lawsuit Against Obama over Amnesty Executive Order

(Washington, D.C., November 20, 2014) Today, in response to the executive order President Barack Obama has signed effectively granting amnesty to about a half of the illegal aliens currently in this country, Sheriff Joe Arpaio of Maricopa County, Arizona filed a lawsuit to enjoin this unconstitutional act. This lawsuit can be found at www.freedomwatchusa.org.

Sheriff Arpaio's lawyer is Larry Klayman of Freedom Watch, former federal prosecutor and founder of both Judicial Watch and Freedom Watch. Mr. Klayman recently succeeded in obtaining a preliminary injunction against the National Security Agency for having unconstitutionally accessed the telephonic metadata of nearly all American citizens. See Klayman v. Obama, et al (Civil Action No. 13-cv-851), filed in the U.S. District Court for the District of Columbia.

Upon filing the complaint, which is styled Arpaio v. Obama, et al. before the U.S. District Court for the District of Columbia (Civil Action No. 14-cv-1966), Sheriff Arpaio issued this statement:

"This unconstitutional act by the President will have a serious detrimental impact on my carrying out the duties and responsibilities for which I am charged as Sheriff. Specifically, it will severely strain our resources, both in manpower and financially, necessary to protect the citizens I was elected to serve. For instance, among the many negative affects of this executive order, will be the increased release of criminal aliens back onto streets of Maricopa County, Arizona, and the rest of the nation.

I am not seeking to myself enforce the immigration laws as this is the province of the federal government. Rather, I am seeking to have the President and the other defendants obey the U.S. Constitution, which prevents this executive order from having been issued in the first place. This unconstitutional act must be enjoined by a court of law on behalf of not just myself, but all of the American people."

They should secure the border themselves, perhaps w/the help of the Minutemen, and do their own deportations.

That will take a governor with guts. Rick Perry now, or Greg Abbott in a couple of months. Time to show what you're made of, guys! Don't disappoint us.

It’s a 3 year statute of limitations on taxes, 6 years for fraud. So long as you don’t commit fraud, but report your income accurately, the statute runs in 3 years. I’m not suggesting it, what needs to happen is to restore the rule of law, not accept that it’s gone. My point is, if it ever becomes a system in which the right of the president to issue this kind of decree is acceptable, there are the kinds of decrees that could be issued. Of course, they never will be, because the Democrat decrees are intended to replace the Americans with voters who will vote for Democrats.

It’s a 3 year statute of limitations on taxes, 6 years for fraud.

Three-year statute of limitations for most civil tax liabilities; 6 years if you omit 25% or more of your gross income; no civil statute of limitations in case of fraud or if you don't file a tax return.

The statute of limitations for criminal tax violations is also 6 years.

So, if you don't omit your income, but tell what it was truthfully, and don't commit fraud, but only send in whatever the President says, they can't get the correct amount after 3 years, right? Prosecutorial discretion, sounds like to me.

Three years is the statute of limitations to audit your return. If your return is accurate, but you don't pay the amount shown on the return as due, then we are not talking about the audit statute of limitations but rather the collections statute of limitations, which is 10 years.

OK. Never mind.

How about this, then--President changes the form to conform to his flat tax idea. You send in the amount it says on the form. Seems like that is in keeping with the Obama Prosecutorial Discretion doctrine. He is creating forms for illegals to let them work in this country.
