Repentance is one thing. But to those who lost businesses and livelihoods because of this man’s incitement, it is not enough.
He incited a riot. Repentance can reduce his punishment but it is not something a civilized society can simply look past.
It seesm to me to clearly be , "Incite to Riot," his lawyer is trying desperately to get this "bystander" to shut his yap so they can have a chance of cashing in latter.
Somebody, please, just nuke the neighborhood.
The real question should be: “why was the media right there with a camera and mic singling him out?”

if his words caused no trouble, then why is he apologizing? for what is he sorry? for expressing his raw emotion that had nothing to do with the looting and fires and destruction that night?
well then, this journalist is disingenuous... no surprise there... in the article, he is called her husband:

I guess I missed the part where he said, “I offer my deepest apologies to Officer Wilson and the City of Ferguson for my son’s inexcusable, unprovoked attack. Officer Wilson had every right to defend himself. “
An apology does not erase the crime. The apology and his emotional state may serve as mitigation, though.
