I frankly have no idea how much discretionary power the president has in this area. Congress has been deeply involved over the years in sanctions debates; I don't know if the president has the authority to act unilaterally.

If Obama attempts an unprecedented power grab on sanctions, it creates an interesting situation because economic sanctions involve prohibiting otherwise lawful trade or investment. Such an action automatically creates an injured party, or multiple injured parties, in both the U.S. and the sanctioned country. These parties would presumably have immediate recourse to the courts without interminable arguments over standing. In Obama's power grabs to date, standing has been a recurring hurdle for opponents. That would not be the case here.

I may object to Obama's actions on the DREAM Act, DOMA, Obamacare, and immigration, but my philosophical and policy disagreements may not get me very far in court. But if Obama tells me that I can't sell a paperclip to an Israeli because he's decisded he prefers Hamas to Likud, I have a dollars and cents injury, and I can be in court the next day.
