Under these circumstances, an honest system would let the Comptroller's office be operated administratively until the new Governor takes office. Then the new Governor and GA can process the nomination and confirmation without any constitutional issue.

There is no political upside for the Democrats to publicly muscle in an appointment which wields very little political power and a limited number of patronage jobs. And only for a very limited time.
