Even if Republicans shut down the Department of Homeland Security (DHS) next year, President Obama could still carry out his executive actions giving legal status to up to 5 million undocumented immigrants.
Speaker John Boehner (R-Ohio) and other GOP leaders have punted the funding fight over Obamas immigration action to February, arguing their new majority will have more leverage to stop the plan dead in its tracks.
But its unclear how much weight the threat of withholding funding would carry. Eighty-five percent of DHS employees continued to work during last years 16-day shutdown because they were funded with mandatory funds or deemed essential to national security or public safety, according to figures the Congressional Research Service (CRS) tracked down for GOP lawmakers. Only 15 percent of DHS employees were furloughed in last years shutdown, the CRS found. On top of that, some 90 percent of the departments U.S. Citizenship and Immigration Services (USCIS), the agency key to implementing Obamas executive action, continued operating.
Some rank-and-file Republicans are worried that Obama could declare all DHS workers essential and keep them on the job then simply pay them once a funding deal is reached.

We need an alternative word for “shutdown”. The federal government never shuts down and employees always get paid time off.
Perhaps we call it a government “vacation”.
No way to! America's Federal Government is now under the complete control of the communists Democrats. The next two years will complete the transformation to a third world status and nothing the GOP can do about it. When we do get control in the Senate in January we still will be unable to change a damn thing. Defund is a joke.
I submit that a simple change in language could go a long way toward turning it around to our advantage.
Call it a "government slowdown" instead.
That has all kinds of good connotations to it. It's not scary. It's inviting. It's so similar to that other phrase the dems use that it makes the transition to using it quite easy.
It's not scary either.
And, wouldn't a lot of America WANT government to slow down.

The challenge with that is that most of the Citizenship and Immigration Service’s operations are funded by fee for service. Unlike most of the rest of the government, their default setting is “on” (so long as the money from immigrants keeps flowing in), and since they aren’t funded by appropriated money, they don’t shut down.
The only way to shut them down would be a piece of legislation ordering them to do so. But it would need enough votes to override the expected veto.
