I hope Klayman files an appeal because his argument for standing is very strong as can be seen in the post #4 link. Any judge who follows the law will grant standing. The links in post #1 have Obama’s response which is very weak in everything including standing.
Obama’s approach is so disengenuous which shouldn’t surprise anyone. His lawyers claim his executive amnesty action is just policy or politics and not law. So because his actions are not grounded in law and are just matters of discretion, no one is allowed to sue him. Klayman and Abbott both demolish this argument of ‘discretion’.
So it’s clear why Obama did not sign an executive order because doing so would put him on the hook legally.
I’m skeptical anybody/ thing can stop him and all the bureaucrats on anything. The country is dysfunctional in case no one noticed.
If illegal aliens, the president and federal judges don’t have to obey the law, why do any of the rest of us?

I am a supporter of Sheriff Joe and his willingness to stand up against this de facto amnesty. However, as a state empowered official he has zero legal authority when it comes to federal property. Please remember that the federal government is still a separate sovereign from the state of Arizona.
Nowhere in “Kelo” does it give the “state” the authority to seize federal property through eminent domain.
If an elected sheriff in a state with an immigration problem doesn’t have standing to sue for relief then who the bleep WOULD have standing? The sheriff could demonstrate his lack of standing by rosd-blocking and arresting every Feral bleephole who tries to move in his county. And I’ll send him another contribution to help finance the effort.

Worse. She’s an Obama appointee. Now that Zero and Reid have packed the courts by exercising the “nuclear option” that Senate Republicrats were too timid to use when they were nominally in charge, this is what we can expect from here in.
